RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2012-03753 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: His Fitness Assessment (FA) dated 10 Jul 12 be removed from the Air Force Fitness Management System (AFFMS). _________________________________________________________________ APPLICANT CONTENDS THAT: The testing number pinned to his Physical Training uniform was turned around during the completion of the aerobic component. The Physical Training Leader (PTL) was not able to see his number. His laps were miscounted and he had to run an extra lap. The applicant’s complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant failed the FA dated 10 Jul 12. On 14 Sep 12, AFPC/DPSIM sent a memorandum to applicant requesting additional documentation. Specifically, a signed fitness score sheet. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIM recommends denial. DPSIM notes the commander has the authority to invalidate a FA based on an injury or illness that occurred during the test; however, the AFI does not provide any guidance that supports commanders invalidating FA for any other purpose. DPSIM further notes the support memorandum provided by the applicant was not signed by his commander and; therefore, does not confirm its validity. Furthermore, the applicant did not provide the additional documents requested. Based on the memorandum describing the events of the administration of the cardio component of the FA, DPSIM concludes there is no discrepancy in regards to the number of laps the applicant performed. The memorandum indicates the test administrators verified the lap count before they recorded the time on the applicant’s score sheet. The complete DPSIM evaluation, with attachment, is at Exhibit B. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 8 Feb 13, for review and comment within 30 days. As of this date, this office has received no response (Exhibit C). _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. After thoroughly reviewing the evidence of record and noting the applicant’s contentions, we are not persuaded the contested FA is in error or unjust. The unsigned memorandum from the applicant’s commander is noted; however, in the absence of a signature and a copy of his signed fitness score sheet from the FA in question, we find insufficient evidence to warrant disturbing the record. However, should the applicant provide such evidence, we would be willing to reconsider his request.
